Slumped in the Saddle

Ever break a law you didn’t know existed? You are either very unlucky or extremely dumb and it’s too bad you can’t plead “dumb” in a court of law.
Police arrested a man for driving drunk on a horse, according to ABC News.
It’s as simple as that. He got drunk at a bar, got on his horse and tried to get a ride home. Doesn’t that technically make the horse the designated driver?
He even was warned by the owner of the bar where he was drinking not to ride his horse home. The only way this could get better is if the horse told him to call a cab as well.

Something important is missing in the logic of this law: The horse is not a machine operated by the driver, but rather is an animal with a (in this case, likely far more intelligent and even sober) brain of its own. Most horses know the way home and unless the horse had a little whiskey in the oats too, will be the sober for the run home.

well, if the guy were to pass out while on the horse and fall off the horse, he could possibly fall into the street and into traffic, also, he could lead the horse into the wrong lane of traffic, assuming this occurred at night or in bad weather conditions, he and the horse could also be hit by a vehicle, and the horse wouldn’t know to get out of the way, horses w/o riders don’t, so horses w/intoxicated riders wouldn’t either….

It’s a horse. Not a damn deer. Horses get spooked by a twig breaking. So what do you think they’ll do if they hear an engine coming toward them. Run. But that is a stupid law. A horse is not machinery.
